• Contact data: name, email, phone, company.
• Technical data: IP address, browser, device, pages visited (via cookies and Google Analytics 4).
• Project data: documents or code you send us during a project.

3 – Why We Use It

• Answer enquiries and provide quotations.
• Deliver and improve our services.
• Send operational or marketing messages (opt-out anytime).
• Comply with legal and tax obligations.

4 – Legal Grounds (GDPR)

Contract performance, legitimate interest, consent (for analytics/marketing cookies) and legal obligation.

5 – Sharing & Transfers

We never sell your data. It may be shared with trusted sub-processors (cloud hosting, email), professional advisers, or authorities when legally required. Data may be processed outside the EEA using EU Standard Contractual Clauses.

6 – Retention

Enquiries: 12 months. Project files: 7 years after completion. Accounting records: 10 years.

7 – Security

HTTPS encryption, access controls and regular audits reduce risk, but no system is 100 % secure.

8 – Your Rights

You may access, correct, delete or export your data and object to processing. Email [email protected]; we reply within 30 days. You can also complain to the Portuguese DPA (CNPD).

9 – Children

This site is not directed to minors under 16; we do not knowingly process their data.

10 – Changes

Policy updates will be posted here. Continued use of the site means acceptance of the revised terms.

By accessing itxmind.com or engaging our services you agree to these Terms. If you disagree, please do not use the site.

3 – Services

We provide custom software development, AI & data science, cloud migration, cybersecurity, near-shore staffing and technical training (“Services”). Specific scope, pricing and timelines are set in individual Statements of Work (SOW). If there is conflict, the SOW prevails.

4 – Site Usage

• Content may be viewed or printed for personal, non-commercial use only.
• No scraping, reverse-engineering or security breaches.

5 – Intellectual Property

All content on the site is owned by ITXMind or its licensors. Upon full payment, IP in deliverables described in an SOW transfers to the Client, excluding our pre-existing tools and libraries (licensed, not assigned).

6 – Confidentiality

Each party must protect the other’s Confidential Information with reasonable care and use it only to perform the contract.

7 – Payment

Invoices are payable within 30 days. Late payments incur 1.5 % interest per month. Prices exclude applicable VAT.

8 – Warranties & Liability

Services are provided with reasonable skill but otherwise “as is”. ITXMind is not liable for indirect or consequential damages; aggregate liability is limited to fees paid in the previous 12 months.

9 – Indemnity

You will indemnify ITXMind against claims arising from your misuse of the Site or materials you supply.

10 – Governing Law

These Terms are governed by Portuguese law. Courts of Lisbon have exclusive jurisdiction.

11 – Changes

We may update these Terms; material changes will be announced on the site. Continued use constitutes acceptance.

12 – Severability

If a clause is held invalid, the remaining clauses stay in effect.
